Terms and Conditions for Kultured Wellness /

Mandala Project Alpine Hike 2025:

1. The full cost of the Hike is due at the time of booking registration. Payment can be made
by credit card, PayPal or bank transfer. Only once payment has been received in full will
your place on the Hike be secured.

2. Paying any amount towards your Hike defaults as acceptance of Kultured Wellness Pty
Ltd Booking Terms and Conditions and The Mandala Project (ACN: 624 575 551) Terms and
Conditions.

3. The Booking Terms and Conditions and Booking Cancellation and Change policies,
restrictions and fees of any 'Operators' of your booking will apply to all bookings.

4. An 'Operator' is any business that Kultured Wellness Pty Ltd engages to deliver all or part
of your Hike or you engage for transportation, accommodation etc. to the Hike starting point. 

5. Kultured Wellness Pty Ltd and their Staff and Directors will not be liable for any loss,
damage or delay arising from any event beyond their control.

6. When components of your Hike are booked for you with or through external Operators
such as The Mandala Project, these have been booked in good faith by Kultured Wellness
Pty Ltd for you and Kultured Wellness Pty Ltd should not be held at fault or liable for the non-
delivery of products or services for whatever reasons by these Operators.

7. Prices quoted include Australian GST.

8. Kultured Wellness Pty Ltd will not be liable for any closures, cancellations, disruptions or
otherwise to your travel plans due to weather, Coronavirus and other pandemic events and
subsequent flight, travel or border restrictions, political or other events, force majeur, war,
natural events or disaster, foreclosure, terrorism, or other factors beyond their control.

9. Hiking is a physical endurance activity generally in a mountain environment. Kultured
Wellness Pty Ltd makes no warranty in regard to a customers physical preparedness or
appropriate health, fitness, age, clothing and equipment.

10. Kultured Wellness Pty Ltd recommends that if you have past or current medical conditions
or injuries or have any known health concerns or risks, that may impair or impact your ability
to complete the walk or provide risk to you, that you speak to your GP or medical
professional prior to booking.

In case of injury or illness, you hereby authorise The Mandala Project to obtain any medical
attention deemed appropriate, including ambulances and/or a helicopter, and you agree to
accept responsibility for any costs incurred.

11. By registering and paying any amount towards your Hike, you acknowledge and accept
the risks associated with hiking and release Kultured Wellness Pty Ltd, their Staff and
Directors from any liability, claims or causes of action arising out of any injury, illness, death
or property damage that may occur during the Hike. Kultured Wellness Pty Ltd also reserves
the right to refuse participation to anyone they deem physically, mentally or medically unfit to
undertake the Hike. Where is TMP indemnity?

I am aware that all care and responsibility will be undertaken by The Mandala Project staff
whilst participating in the Kultured Wellness Alpine Hike. I am also aware that it is a
condition of my participation in this program that The Mandala Project staff, contractors
and agents are absolved from all liability howsoever arising from injury or damage caused
(whether direct, indirect, consequential or special, fatal or otherwise) arising out of my
participation, except where such liability arises due to a negligent act or omission on the
part of staff.

12. Kultured Wellness Pty Ltd recommends that you purchase comprehensive Travel
Insurance and have Ambulance Cover and ensure you are covered in Victoria.

13. Participants are expected to behave in a respectful and responsible manner at all times
during the Hike. Any behaviour deemed unacceptable by Kultured Wellness Pty Ltd may
result in immediate expulsion from the Hike at the cost of the Customer and without refund.

14. Kultured Wellness Pty Ltd reserves the right to make changes to the itinerary, including
route changes or cancellations due to weather or other unforeseen circumstances as listed
in point 7. In such cases, Kultured Wellness Pty Ltd will make every effort to provide suitable
alternatives.

15. You may cancel your booking up to 90 days prior to the start date of the Hike without
penalty. If you cancel within 90 days of the Hike start date, it is at the discretion of Kultured
Wellness Pty Ltd to determine the refund amount, if at all. Kultured Wellness Pty reserves
the right to cancel the Hike at any time due to unforeseen circumstances, in which case a full
refund will be provided.
Privacy Statement: The Mandala Project acknowledges & respects the privacy of individuals.
The information that is being collected in the registration form is for the purposes of
gathering medical information. The Mandala Project, it's authorised staff and contracted
service providers, such as, government agencies covered by law, may be recipients of this
information. You have the right to access & alter personal information protecting yourself in
accordance with the Commonwealth Privacy Act (Amended 2001).

16. These Terms and Conditions are governed by and construed in accordance with the laws
of Queensland, Australia where Kultured Wellness Pty Ltd is based. Any disputes arising
from the Terms and Conditions or the Hike, will be resolved in accordance with the laws of
that State.
